Confusion with respect to land acquisition proceeding has been put to rest by Indore Development Authority Case decided by Constitution Bench of the Supreme Court of India.

Haryana State Industrial And Infrastructure Development Corporation Ltd. (HSIIDC) & Others
v.
M/s Honeywell International (India) Pvt. Ltd.
Facts: A Bunch of #CivilAppeals were filed before the #SupremeCourt by the Haryana State Industrial and Infrastructure Development Corporation Limited, (#HSIIDC’) and the #State of #Haryana against the order passed by the #HighCourt of Punjab & Haryana #atChandigarh on two counts:
1. Acquisition/Acquisition proceedings with respect to the respective lands in question has/have lapsed under Land Acquisition Act 1894.
2. #Declaration that the acquisition with respect to the lands in question is deemed to have lapsed under Section 24(2) of the Right to Fair Compensation & Transparency in Land Acquisition, Rehabilitation & Transparency in Land Act 2013 (#RFCTLARR).
3. Original Writ petitioners submitted #amendmentapplications for the relief of #deemedlapse of acquisition under Section 24(2) of the Act, 2013 on the grounds that neither the possession was taken over nor the compensation was paid/tendered.
4. The #HighCourt #withoutdeciding the petition #onmerit and the grounds on which the acquisition/acquisition proceedings under the Act, 1894 were under challenge, #solelyrelied upon the #decision of this Court in the case of #PuneMunicipalCorporation v. Harakchand Misirimal Solanki and allowed the writ petitions and declared that the acquisition with respect to the lands in question is deemed to have lapsed under Section 24(2) of the Act, 2013.
5. Further declaration was also made by the High Court that acquisition proceedings deemed to have lapsed based on the judgement of Pune Municipal Corporation v. Harakchand Misirimal Solanki.
Observation of the Apex Court:
1. The Writ Petitions (#WP) which were #only filed for #gettingrelief after the Act 2013 came into force u/s 24(2) are #notsustainable in view of the #decision of the #ConstitutionBench of the Apex Court in the case of #IndoreDevelopmentAuthority v. Manoharlal & Others Etc., accordingly,
(a)in case possession has been taken, compensation has not been paid then there is no lapse. Similarly, if compensation has been paid, possession has not been taken then also there is no lapse.
(b) The provisions of Section 24(2) providing for a deemed lapse of proceedings are applicable in case authorities have failed due to their inaction to take possession and pay compensation for five years or more before the Act of 2013 came into force, in a proceeding for land acquisition pending with concerned authority as on 1.1.2014
(c) Section 24(2) of the Act of 2013 does not give rise to new cause of action to question the legality of concluded proceedings of land acquisition. Section 24 applies to a proceeding pending on the date of enforcement of the Act of 2013, i.e., 1.1.2014.
2. In some cases, WP were dismissed by the High Court. The Writ petitioners whose petitions were dismissed submitted that as the possession report was not furnished, therefore the actual physical possession in their cases was not taken over.
3. Argument of the State of Haryana & HSIIDC:
(a)In view of the decision of the Constitution Bench in the case of Indore Development Authority v. Manoharlal & Others Etc., the contention of the Writ Petitioners is not sustainable.
(b)Once the possession of the land in question with respect to the landowners/writ petitioners, is already taken over and even the compensation has been paid/deposited, the acquisition/acquisition proceedings under the Act, 1894 is/are not required to be quashed and set aside.
4. As the High Court has not considered the other grounds challenging the acquisition/acquisition proceedings under the Act, 1894 on merits, therefore the matter is remanded back to the High Court for consideration and decision on merit of the case.
5. All the civil appeals arising out of the impugned common judgments and orders passed by the High Court of Punjab and Haryana at and other allied writ petitions are allowed.
6. The judgment(s) and order(s) passed by the High Court declaring that the acquisition with respect to the lands in question deemed to have lapsed under Section 24(2) of the Act, 2013 is/are hereby quashed and set aside.
7. The matters was #remittedback to the #HighCourt to #decide and dispose of the main writ petitions afresh in accordance with law and on their own #merits on other issues except the applicability of Section 24(2) of the Act, 2013. Preferably within a period of nine months from the date of receipt of the present order.
Decision:
The Bench of Apex Court comprising Hon’ble Mr Justice M R Shah J & Hon’ble Mr. Justice C T Ravikumar J vide their order 11.04.2023 #allowed the #appeals and #setaside the #order of the #HighCourt declaring acquisition proceedings deemed to have lapsed and remanded matter back to the High Court for #decision on #merit #except the submission of #applicability of Section #24(2) of the #RFCTLARR2013.

जेल में बंद दुष्कर्मियों की हालत पर फिल्म बनाकर समाज में दिखाएं, ताकि पैदा हो खौफ : सुझाव
चैतन्य भारत न्यूज इंदौर. देशभर में बढ़ रहे रेप के मामलों पर आक्रोशित जनता दोषियों के लिए कड़ी से कड़ी सजा की मांग कर रही है। कोई दुष्कर्म के आरोपियों को फांसी देने की मांग कर रहा तो कोई उन्हें बीच चौराहे पर मारने की बात कर रहा है। दुष्कर्म के दोषियों के मन में खौफ पैदा करने के लिए हाईकोर्ट की इंदौर खंडपीठ ने सुनवाई के दौरान सुझाव दिया कि दुष्कर्मियों को सजा मिलने के बाद उनकी हालत पर फिल्म बनाकर दिखाई जाना चाहिए। इससे ऐसी घटनाओं में कमी आ सकती है। (adsbygoogle = window.adsbygoogle || ).push({}); हाईकोर्ट इंदौर खंडपीठ ने ज्यादती के एक मामले में दोषी की फांसी की सजा यथावत रखने या नहीं रखने को लेकर सुनवाई की। सुनवाई के दौरान यह बात उठी कि ज्यादती की घटना बढ़ती जा रही हैं। इसके लिए सजा भी मिल रही है। लेकिन ऐसी घटनाओं को कैसे रोका जाए? हाई कोर्ट ने सवाल किया कि इसे रोकने के लिए क्या किया जा सकता है। दुष्कर्मियों की हालत पर बननी चाहिए फिल्म इस मामले में हाई कोर्ट द्वारा नियुक्त न्यायमित्र अविनाश सिरपुरकर, अतिरिक्त महाधिवक्क्ता रविंद्रसिंह छाबड़ा ने कहा कि, जैसे सिनेमा और टीवी पर सिगरेट और तंबाकू के दुष्परिणाम पर शॉर्ट फिल्में दिखाई जाती है, वैसे ही दुष्कर्मियों को भी सजा मिलने के बाद उनकी हालत पर फिल्म बनाकर समाज को दिखाई जानी चाहिए। ऐसे प्रयासों से इस तरह की घिनौनी घटनाओं में कमी आ सकती है। साथ ही दुष्कर्म जैसी घटनाओं को अंजाम देने वालों के भीतर खौफ पैदा होगा। ये भी पढ़े... उप्र : दुष्कर्म पीड़िता के घर पर चिपकाया पोस्टर, मिली उन्नाव से भी भयंकर घटना की धमकी, आरोपी गिरफ्तार निर्भया सामूहिक दुष्कर्म के दोषियों को फांसी देने की तैयारी शुरू, 16 दिसंबर को मिल सकती है फांसी उन्नावः जमानत पर छूटे दुष्कर्म आरोपितों ने पीड़िता पर पेट्रोल डालकर जिंदा जलाया, हालत गंभीर Read the full article
